The results of the recent election for Lakeway Mayor are being challenged by candidate Tiffany McMillan on the basis that the failure to order a run off election breaches the Texas Electoral Code. McMillan is seeking injunctive relief and costs in a Travis County Court action filed earlier this week. See the suit HERE.
After voting had started the City Council reversed a 2014 Charter change to three year terms that had triggered the majority requirement – complicating the issue still further.
The City has filed a counter brief (HERE) with the court and Sandy Cox has actually been sworn in as Mayor – although, according to formar Mayor Joe Bain’s blog she was not covered by the City’s law suit protection at the time and has been forced to hire separate counsel.
Sandy Cox has not responded to our requests for comment. City Manager Steve Jones has declined to comment but stated the City may have a statement later on Thursday.
The Court is expected to rule Thursday afternoon.
